PRIVACY POLICY

I, JUDr. Jan Mikš, CIN: 66198721, TIN: CZ500210030, with registered office at Dieselova 258/26, Petrovice, 109 00 Prague 10 (hereinafter referred to as “JM”), the Operator of Rezidence Za Vodou, process the personal data of my customers in connection with my business activities as a data controller.

The purpose of this document is to inform you about what I need your personal data for, how
I will handle it and what rights you have in this context.

When processing your personal data, I act in accordance with the relevant applicable legislation of the Czech Republic and the European Union, in particular Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as the “GDPR”). I am constantly striving to improve the standard of your personal data security to protect it from potential abuse.

1.Why do I need your personal data?
I process your personal data primarily for the purpose of providing accommodation services, booking accommodation and re-offer of accommodation services.

2.What personal data do I process and where do I get it from?
I only process personal data that you provide me when booking the accommodation or checking in. Specifically, name, surname, telephone, e-mail, ID or travel document number, permanent address, date of birth and period of accommodation.

3.Do I need your consent to process your personal data?
I may process your personal data without your consent. The legal basis for the processing of your personal data is Article 6(1)(b) of the GDPR – the processing is necessary for the fulfilment of obligations under the concluded contract for the provision of accommodation services. Subsequently, I use your personal data to fulfil my legal obligations in keeping accommodation books, accounting and tax records (in the area of tax and accounting), in which case the legal basis for processing is Article 6(1)(c) of the GDPR, where the processing is necessary to fulfil a legal obligation of the controller.

Finally, I use the personal data of existing customers to send commercial communications, which is considered to be processing carried out for legitimate interest under Article 6(1)(f) of the GDPR. If you do not wish to receive my further commercial communications, it is sufficient if you object. You can withdraw your consent to the processing of your personal data at any time. 4.Who has access to your personal data?
I do not pass on your personal data to third parties for their own marketing purposes. In addition to me, those who provide individual services for me (booking system, advertising services, etc.) have access to your personal data. I require all persons to whom I disclose your personal data to adhere to sufficient standards of security of your personal data and to comply strictly with their legal obligations regarding the handling of personal data.

Your personal data may only be transferred for processing within the EU.

I diligently protect your personal data. I process your personal data both electronically and manually, but in both cases I take security measures, technical, mechanical and organisational. I require at least the same standard of security from our contractual partners as data processors.

5. How long do I keep your personal data?
I keep your personal data for the period necessary to ensure the mutual rights and obligations arising from the concluded contract for the provision of accommodation services and for the period for which I am obliged to keep the data according to the relevant legislation, i.e. for 6 years. I use your personal data to send you commercial communications until you object and unsubscribe from receiving commercial communications.

6. What rights do you have in relation to processing your personal data?
You have the following rights in relation to the processing of your personal data:

• the right to access your personal data. Do you want to know what data I keep about you? Upon your request, I will confirm whether and to what extent your personal data is processed, for what purpose, to which recipients it is disclosed, for how long the data will be stored and what other rights you have in connection with the processing of your personal data. Upon request, I will provide you with a copy of the personal data processed.

 

• the right to rectification. Has any of your personal data changed? Please let me know as soon as possible. If you notify me, I will update the personal data I keep about you without undue delay and correct any inaccuracies.

 

• the right to erasure. Do you not want me to use your personal data? If I no longer need your personal data for the purposes for which I processed it, or if I processed your personal data unlawfully, I will destroy it without undue delay upon your request.

 

• the right to restriction of processing. Do you want to limit the extent to which I use your personal data? If you request it, I will restrict the processing of your personal data in the following cases:
  
  • (i) for the time necessary to verify the accuracy of the personal data, if you dispute the
    accuracy of the data,
  • (ii) I have processed your personal data unlawfully,
  • (iii) I no longer need your personal data for the purposes for which I processed it; or
    (iv) you have objected to the processing of your data for the purposes of protecting my legitimate interests and I have not yet assessed whether your legitimate grounds for the disposal of your data outweigh my legitimate interests. Unlike erasure, in this case your personal data will remain stored by me, but I will not use them for the purposes for which the processing was restricted.

 

• the right to object to the sending of commercial communications. Do you no longer wish toreceive my commercial communications? You can object at any time. Simply click on the link located at the foot of each e-mail message and unsubscribe from receiving commercial offers. Or send me an email at: info@rezidencezavodou.cz. I will process your request as soon as possible and confirm that you have been unsubscribed from receiving commercial communications. After that, I will no longer use your personal data for marketing purposes.

 

• the right to make an objection. You can also object if you do not consent to the processing of your personal data for the purpose of protecting my legitimate rights and interests other than direct marketing. I will then only process your personal data for the establishment, exerciseor defence of my legal claims or where my compelling legitimate grounds for processing outweigh your interests and data protection rights. Please be sure to tell me what specifically bothers you.

 

• the right to be notified of a personal data breach. Has your personal data fallen into unauthorised hands? If, despite our best efforts, your personal data has been breached and the situation poses a significant risk to you, I will inform you without undue delay. I do not have to let you know only if I have encrypted your personal data and it is unintelligible to a third party or if I have managed to eliminate the risks arising from the disclosure of your personal data.

 

• the right to lodge a complaint. Are you unhappy with the way I process your personal data? If you believe that I am processing your personal data in violation of generally binding legislation, in particular the GDPR, you have the right to file a complaint with the Data Protection Authority. But I will be happy if you tell me first and we will sort everything out together.

7. Cookies
Cookies are small files that store information in your browser and are used to distinguish visitors to a website. Personal or sensitive data is never placed in cookies. Only e.g. numerical identification codes, status variables, etc. are stored in the form of cookies. Without cookies, it is technically impossible to implement the functions that require information about the visitor accessing the website. This includes, for example, booking, multi-step ordering, user logging into the system, etc.

There may also be statistical and advertising services on the website such as Google Analytics, Google AdWords, List Sklik and the like that use cookies. These cookies (if any are used) are mainly used to analyse website traffic and to evaluate the performance of different sales channels and to personalise content and better target advertising.
